d)reimburseallcostsandchargesincurredbythesellerinprovidingassistanceasenvisa

B7Noticestotheseller

Thebuyermust,wheneveritisentitledtodeterminethetimewithinanagreedperiodand/or

thepointoftakingdeliverywithinthenamedplace,givethesellersufficientnoticether

eof.

B8Proofofdelivery

Thebuyermustprovidethesellerwithappropriateevidenceofhavingtakendelivery.

A9Checking–packaging–marking

Thesellermustpaythecostsofthosecheckingoperations(suchascheckingquality,measu

ring,weighing,andcounting)thatarenecessaryforthepurposeofdeliveringthegoodsin

accordancewithA4.

Thesellermust,atitsownexpense,packagethegoods,unlessitisusualfortheparticular

lermaypackagethegoodsinthe

mannerappropriatefortheirtransport,unlessthebuyerhasnotifiedthesellerofspecif

ingistobemark

edappropriately.

A10Assistancewithinformationandrelatedcosts

Thesellermust,whereapplicable,inatimelymanner,providetoorrenderassistanceinob

tainingforthebuyer,atthebuyer’srequest,riskandexpense,anydocumentsandinforma

tion,includingsecurity-relatedinformation,thatthebuyerneedsfortheexportand/or

importofthegoodsand/orfortheirtransporttothefinaldestination.

B9Inspectionofgoods

Thebuyermustpaythecostsofanymandatorypre-shipmentinspection,includinginspecti

onmandatedbytheauthoritiesofthecountryofexport.

B10Assistancewithinformationandrelatedcosts

Thebuyermust,inatimelymanner,advisethesellerofanysecurityinformationrequireme

ntssothatthesellermaycomplywithA10.

Thebuyermustreimbursethesellerforallcostsandchargesincurredbythesellerinprovi

dingorrenderingassistanceinobtainingdocumentsandinformationasenvisagedinA10.

nnominatedbythebuyerontheseller’smeansoftransportreadyforunloading.

IfnospecificpointhasbeennotifiedbythebuyerunderB7d)withinthenamedplaceofdeliv

ery,andifthereareseveralpointsavailable,thesellermayselectthepointthatbestsui

If

a)thebuyerfailsinaccordancewithB7tonotifythenominationofacarrieroranotherpers

onasenvisagedinA4ortogivenotice;or

b)thecarrierorpersonnominatedbythebuyerasenvisagedinA4failstotakethegoodsinto

itscharge,then,thebuyerbearsallrisksoflossofordamagetothegoods:

(i)fromtheagreeddate,orintheabsenceofanagreeddate,

(ii)fromthedatenotifiedbythesellerunderA7withintheagreedperiod;or,ifnosuchdat

ehasbeennotified,

(iii)fromtheexpirydateofanyagreedperiodfordelivery,providedthatthegoodshavebe

enclearlyidentifiedasthecontractgoods.

B6Allocationofcosts

Thebuyermustpay

a)allcostsrelatingtothegoodsfromthetimetheyhavebeendeliveredasenvisagedinA4,e

xcept,whereapplicable,thecostsofcustomsformalitiesnecessaryforexport,aswellas

allduties,taxes,andotherchargespayableuponexportasreferredtoinA6b);

b)anyadditionalcostsincurred,eitherbecause:

(i)thebuyerfailstonominateacarrieroranotherpersonasenvisagedinA4,or

(ii)thecarrierorpersonnominatedbythebuyerasenvisagedinA4failstotakethegoodsin

toitscharge,or

(iii)thebuyerhasfailedtogiveappropriatenoticeinaccordancewithB7,providedthatt

hegoodshavebeenclearlyidentifiedasthecontractgoods;and

c)whereapplicable,allduties,taxesandotherchargesaswellasthecostsofcarryingout

customsformalitiespayableuponimportofthegoodsandthecostsfortheirtransportthro

ughanycountry.

A7Noticestothebuyer

Thesellermust,atthebuyer’sriskandexpense,givethebuyersufficientnoticeeithert

hatthegoodshavebeendeliveredinaccordancewithA4orthatthecarrieroranotherperson

nominatedbythebuyerhasfailedtotakethegoodswithinthetimeagreed.

A8Deliverydocument

Thesellermustprovidethebuyer,attheseller’sexpense,withtheusualproofthatthego

odshavebeendeliveredinaccordancewithA4.

Thesellermustprovideassistancetothebuyer,atthebuyer’srequest,riskandexpense,

inobtainingatransportdocument.

A9Checking–packaging–marking

Thesellermustpaythecostsofthosecheckingoperations(suchascheckingquality,measu

ring,weighing,counting)thatarenecessaryforthepurposeofdeliveringthegoodsinacc

B8Proofofdelivery

ThebuyermustaccepttheproofofdeliveryprovidedasenvisagedinA8.

B9Inspectionofgoods

Thebuyermustpaythecostsofanymandatorypre-shipmentinspection,exceptwhensuchins

pectionismandatedbytheauthoritiesofthecountryofexport.

B10Assistancewithinformationandrelatedcosts

Thebuyermust,inatimelymanner,advisethesellerofanysecurityinformationrequireme

ntssothatthesellermaycomplywithA10.

Thebuyermustreimbursethesellerforallcostsandchargesincurredbythesellerinprovi

dingorrenderingassistanceinobtainingdocumentsandinformationasenvisagedinA10.

“CarriagePaidTo”meansthatthesellerdeliversthegoodstothecarrieroranotherpers

onnominatedbytheselleratanagreedplace(ifanysuchplaceisagreedbetweentheparties

)andthatthesellermustcontractforandpaythecostsofcarriagenecessarytobringthego

odstothenamedplaceofdestination.

WhenCPT,CIP,CFRorCIFareused,thesellerfulfilsitsobligationtodeliverwhenithands

thegoodsovertothecarrierandnotwhenthegoodsreachtheplaceofdestination.

Thisrulehastwocriticalpoints,becauseriskpassesandcostsaretransferredatdiffere

tiesarewelladvisedtoidentifyaspreciselyaspossibleinthecontract

boththeplaceofdelivery,wheretheriskpassestothebuyer,andthenamedplaceofdestina

tiontowhichthe

ralcarriersareusedforthecarriagetothea

greeddestinationandthepartiesdonotagreeonaspecificpointofdelivery,thedefaultp

ositionisthatriskpasseswhenthegoodshavebeendeliveredtothefirstcarrieratapoint

entirelyoftheseller’schoosingandoverwhichthe

CPTrequiresthesellertoclearthegoodsforexport,r,theselle

thesellersufficientnoticethereof.

Thesellermustpaythecostsofthosecheckingoperations(suchascheckingquality,measu

ring,weighing,counting)thatarenecessaryforthepurposeofdeliveringthegoodsinacc

ThebuyermustacceptthetransportdocumentprovidedasenvisagedinA8ifitisinconformi

tywiththecontract.

B9Inspectionofgoods

Thebuyermustpaythecostsofanymandatorypre-shipmentinspection,exceptwhensuchins

pectionismandatedbytheauthoritiesofthecountryofexport.

A10Assistancewithinformationandrelatedcosts

Thesellermust,whereapplicable,inatimelymanner,providetoorrenderassistanceinob

tainingforthebuyer,atthebuyer’srequest,riskandexpense,anydocumentsandinforma

tion,includingsecurity-relatedinformation,thatthebuyerneedsfortheimportoftheg

oodsand/orfortheirtransporttothefinaldestination.

Thesellermustreimbursethebuyerforallcostsandchargesincurredbythebuyerinprovid

ingorrenderingassistanceinobtainingdocumentsandinformationasenvisagedinB10.
